This visa is suitable for those companies who intend to open a branch office in the USA and to send an employee to operate it in the USA. This category is for managers and executives who are being transferred to a U.S. office that is a subsidiary, branch, affiliate, or parent company of a foreign employer.
Note: Qualified employees entering the United States to establish a new office will be allowed a maximum initial stay of one year. Further extension of stay may be granted in increments of up to an additional two years until the employee has reached the maximum limit of seven years.
Work for the Right Company: The worker must currently work for a multinational company that has a connection to a company in the U.S. This connection can be as a parent, child, sister, or branch company of the U.S. company.
Job Requirements: If the worker is applying as an L-1A (a manager or executive), they should be coming to the U.S. to do a job as a manager or executive. This usually means they oversee a big part of the company’s work or manage an important job.
Work Experience: The worker should have worked for the foreign company for at least one year within the last three years before applying for the L-1 visa. And this work should have been done outside of the U.S.
The processing time for an L-1 visa can vary, depending on the USCIS service center where the petition was filed and the complexity of the case. In general, L-1 visas tend to have much faster processing times than other work visa categories.
Certain applicants may also be eligible to request “premium processing” of their Form I-129 for an additional fee. If approved, USCIS will typically process your L-1 visa application within 15-45 calendar days.
